Welcome to XP DEPOT ("Bot", "Service", "we", "us", "our"). These Terms of Service ("Terms") govern your use of our Discord bot and any related services provided by XP DEPOT.

By adding or using XP DEPOT in your Discord server, or by interacting with the Bot in any way, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Bot.

1. Description of Service

XP DEPOT is a Discord bot designed to enhance server engagement through an XP and leveling system, interactive games, automated tasks, and premium features. Features are subject to change, modification, or removal at our discretion.

2. Acceptance of Terms

You must be at least 13 years old to use the Bot, or the minimum age required by Discord's Terms of Service and the laws of your jurisdiction. If you are using the Bot on behalf of a Discord server, you represent that you have the authority to agree to these Terms on behalf of that server.

3. User Responsibilities and Conduct

You agree to use the Bot in compliance with all applicable laws, Discord's Terms of Service, Discord's Community Guidelines, and these Terms. You are responsible for:

• The conduct of users on your server and their interactions with the Bot.
• Ensuring that the use of the Bot on your server does not violate any rules or promote illegal activities.
• Not attempting to exploit, reverse engineer, decompile, or otherwise interfere with the Bot's functionality.
• Not using the Bot for spamming, harassment, or any malicious purposes.

4. Premium Features and Subscriptions

XP DEPOT offers premium features through Discord App Subscriptions ("Exclusive Content").

• Access to certain commands and features may require an active subscription for the server.
• Subscriptions are managed through Discord's platform. Any billing, renewal, or cancellation issues related to subscriptions must be handled through Discord.
• We reserve the right to change the features included in any subscription tier or the pricing of subscriptions at any time.
• No refunds are provided for subscriptions unless explicitly stated or required by applicable law.

5. Bot Availability and Updates

We strive to keep XP DEPOT operational and up-to-date. However, the Bot is provided "as is" and "as available." We do not guarantee that the Bot will always be available, error-free, or uninterrupted. We may perform maintenance, updates, or modifications that could temporarily affect the Bot's availability without prior notice.

6. Intellectual Property

The XP DEPOT bot, including its name, logo, code, design, features, and all related intellectual property, are owned by XP Labs. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Bot as intended within the Discord platform.

Any data generated by users interacting with the Bot on your server (e.g., XP, levels) is stored by us to provide the Service. You and your server members retain ownership of any original content you create and share while using Discord.

7. Data and Privacy

XP DEPOT may collect and store certain data related to your Discord server and its members to provide its services, such as guild IDs, user IDs, XP, levels, and game scores. We are committed to protecting your privacy. Please refer to our Privacy Policy for more information on how we collect, use, and protect your data.

Note: Since XP DEPOT uses MongoDB, ensure your data handling practices align with your Privacy Policy and relevant data protection regulations.

8. Termination

We reserve the right to terminate or suspend access to XP DEPOT for any server or user, at our sole discretion, without prior notice or liability, for any reason, including but not limited to a breach of these Terms or Discord's Terms of Service.

You may stop using the Bot at any time by removing it from your Discord server.

9. Disclaimers

THE BOT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE BOT WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL XP Labs BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE BOT; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Arizona, USA, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
